Important Ruling from European Court on Euthanasia

Here is a link to a report from ADF International about an important ruling from the European Court of Human Rights.

“In a major case on the right to life, the European Court of Human Rights ruled in favour of Tom Mortier, son of Godelieva de Troyer, who died by lethal injection in 2012, aged 64. Her euthanasia was conducted on the basis of a diagnosis of “incurable depression”. In the case of Mortier v. Belgium, the Court found that Belgium violated the European Convention on Human Rights when it failed to properly examine the alarming circumstances leading to her euthanasia.”

Here is a comment from Robert Clarke, deputy director of ADF International:

“It is unfortunate that the Court dismissed the challenge to the Belgian legal framework; however, the takeaway is that the ‘safeguards’ touted as offering protection to vulnerable people should trigger more caution toward euthanasia in Europe, and the world. The reality is that there are no ‘safeguards’ that can mitigate the dangers of the practice once it is legal. Nothing can bring back Tom’s mother, but we hope this decision offers Tom some small measure of justice.”

Richard S. Myers, the Vice-President of UFL, is Professor of Law at Ave Maria School of Law, where he teaches Antitrust, Civil Procedure, Conflict of Laws, Constitutional Law, and Religious Freedom. He is a Phi Beta Kappa graduate of Kenyon College and earned his law degree at Notre Dame, where he won the law school's highest academic prize. He began his legal career by clerking for Judge John F. Kilkenny of the U.S. Court of Appeals for the Ninth Circuit. Professor Myers also worked for Jones, Day, Reavis & Pogue in Washington, D.C. He taught at Case Western Reserve University School of Law and the University of Detroit Mercy School of Law before joining the Ave Maria faculty. He is a co-editor of St. Thomas Aquinas and the Natural Law Tradition: Contemporary Perspectives (Catholic University of American Press, 2004) and a co-editor of Encyclopedia of Catholic Social Thought, Social Science, and Social Policy (Scarecrow Press, 2007). He has also published extensively on constitutional law in law reviews and also testified before Congressional and state legislative hearings on life issues.
